This is related to charges that batters intentionally hit foul balls so that gamblers can bet with fans in the stands. Tipton, who is retired from baseball, came forward and testified that on two occasions when he played for Birmingham in 1957 he was approached while in Chattanooga about deliberately hitting foul balls. On one occasion he was paid $50 by Jesse Levan and on the other occasion he received an envelope with $75 in it. Tipton was released by Birmingham in 1958. The ruling does not affect his ML status and Tipton will receive his major-league pension.
